We obtained a combined workers’ compensation and third-party liability settlement for our client who was struck broadside by a loaded dump truck. The third-party insurance company denied liability on the grounds that the truck driver had the right-of-way and that our client was contributory negligent. A lawsuit was filed and a favorable settlement was achieved at mediation after contentious litigation. (Mecklenburg County, NC – 2010).
